The Challenge

Hatch Studio partnered with a multinational digital product company to conduct an in-depth competitive analysis. The client team, responsible for ensuring online privacy, transparency, and trust across various product areas, focuses on designing safe user experiences and providing tools for informed decision-making.
The project's objective was to examine how different tech companies handle cookie consent, DMA consent, and age verification processes, particularly looking at user flows, design, and copywriting. This analysis was set against the backdrop of the latest privacy regulations, such as the General Data Protection Regulation (GDPR) and the Digital Markets Act (DMA), which impose stricter standards for user consent and data privacy.
We benchmarked consent flows from six major tech companies operating in the EU, identifying best and worst practices. Our goal was to help our client develop an optimal user experience that not only complies with but also surpasses regulatory requirements.

Our Approach

Comprehensive Desk Research
We created accounts on competitors' platforms and meticulously documented the cookie consent, DMA consent, and age verification flows through screenshots. After setting up the accounts, we continued using the products to capture any subsequent consent-related prompts or notifications. All captured screens were then systematically organized and presented to our client.

Detailed Documentation
Each company's flow was analyzed in detail, clearly identifying both good and bad practices. We provided an in-depth commentary on design choices, user experience implications, and compliance adherence. Additionally, we developed an analysis matrix to uncover patterns and anomalies in how these tech companies approached privacy and consent, highlighting the variance in their strategies.

Outcomes

Our findings equipped the client team with a comprehensive dataset of consent flows, enabling them to benchmark against industry standards and identify key areas for improvement. The insights were strategically valuable in several areas: Timing and Intrusiveness, Bundled vs. Granular Consent, Age Verification methods and DMA Consent across multiple products and data sharing.
As a result of our thorough analysis, Hatch Studio was invited to undertake additional projects, reinforcing our client's compliance with new regulations and providing strategic insights to enhance user trust and satisfaction.
